American Cooling Systems, LLC warrants all of its products to be free from defects in material and workmanship. This warranty is subject to the following periods, limitations, conditions and procedures:
AMERICAN COOLING SYSTEMS FANS:
A. If installed on a new or used on-highway vehicle, the warranty period is thirty-six (36) months from the original installation or for 350,000 vehicle miles of fan usage, whichever comes first, or
B. If installed on a new or used off-highway vehicle or stationary engine, the warranty period is twenty (24) months from the original installation or for 5,000 hours of engine’s operation, whichever comes first.
The original installation date and the miles of fan usage or hours of engine’s operation must be verified to the satisfaction of American Cooling Systems. If the original installation date cannot be so verified then it will be set as the date ninety (90) days from the date of manufacture as stamped on the fan. For used vehicles or engines the beginning and ending mileage or hours of operation must be documented.
THIS WARRANTY IS LIMITED TO REPAIRING OR REPLACING ANY GOODS THAT ARE PROVEN TO BE DEFECTIVE, WHICH IS THE SOLE AND EXCLUSIVE REMEDY, AND AMERICAN COOLING SYSTEMS IN NO EVENT SHALL HAVE ANY LIABILITY FOR PAYING INCIDENTAL OR CONSEQUENTIAL DAMAGES. NOTWITHSTANDING ANY OF THESE TERMS AND CONDITIONS, THE WARRANTIES SET FORTH SHALL APPLY IN CONNECTION WITH ANY SALES OF GOODS BY AMERICAN COOLING SYSTEMS AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
This warranty only applies to products properly installed, maintained and serviced that have been determined by American Cooling Systems to have been defective in manufacture. This warranty does not apply to products subjected to misuse, accident damage, alteration or unauthorized repair. Claims may only be made by the original purchaser or user and must be authorized in writing by an American Cooling Systems Representative, prior to incurring any expenses such as labor. All warranty repair or replacement work must be performed at an American Cooling Systems authorized dealer or distributor. All parts repaired or replaced under this warranty will continue to be covered by this warranty for the remainder of the original warranty period only. American Cooling Systems will prepay only, freight charges for authorized return of parts to American Cooling Systems and will pay all freight charges to deliver replacement parts to the claimant.
To make a claim under this warranty, the claimant must, within 60 days of discovering an alleged product defect, deliver the product to an authorized American distributor, dealer or our factory and mail a completed AMERICAN COOLING SYSTEMS Warranty Claim Form. The claimant must retain all components that are replaced in connection with the performance of warranty work until such time as AMERICAN COOLING SYSTEMS reaches a final disposition of the warranty claim.
